Compliance with Laws and Regulations (各種法令等の遵守)

We comply with Laws and Regulations, notices and guidelines regaridng Personal Information and deal with the Personal Information in accordance with the Policy.

弊所は、個人情報等に関する各種法令、通知、ガイドラインを遵守し、本ポリシーに則って個人情報等を適切に取り扱います。

Definition of Personal Information (個人情報等の定義)

“Personal Information” is referred to as the following items; 「個人情報等」とは次のものをいうものとします。

  1. The term “Personal Information” shall mean information regarding a living individual who can identify a specific individual by name, date of birth, and other descriptions contained in the information (including information which can be easily collated with other information and can be utilized in order to identify a specific individual), or includes an individual identification code.「個人情報」とは、生存する個人に関する情報であって、当該情報に含まれる氏名、生年月日、その他の記述等により特定の個人を識別することができるもの（他の情報と容易に照合することができ、それにより特定の個人を識別することができることとなるものを含む。）、又は個人識別符号が含まれるものをいいます。
  2. “Personal Data” means personal information which composes “Personal Information Database”. This “Personal Information Database” is; (i) a collection of information including personal information which is systematically structured so that specific Personal Information can be searched by using a computer, (ii) if case not using a computer, information which can be easily searched by a table of contents, index and a cord etc. to access easily to a specific personal information arranged and classified in paper-processed Personal Information according to certain rules (e.g. the Japanese Syllabary Order, date of birth etc.) .「個人データ」とは、「個人情報データベース等」を構成する個人情報をいいます。 この「個人情報データベース等」とは、次のことを言います；(i) 特定の個人情報をコンピュータを用いて検索することができるように体系的に構成した個人情報を含む情報の集合体、(ii) コンピュータを用いていない場合で、紙面で処理した個人情報を 一定の規則（例えば、五十音順、生年月日順など）に従って整理・分類し、特定 の個人情報を容易に検索することができるよう、目次、索引、符号等を付し、他人によっても容易に検索可能な状態においているもの。
  3. “Retained Personal Data” is, among Personal Data, one that Entities Handling Personal Information has the authority of disclosure, correction of contents, addition and omission, suspension of use, deletion and suspension of offer to the third parties. 「保有個人データ」とは、個人データのうち、個人情報取扱事業者が、開示、内容の訂正、追加又は削除、利用の停止、消去及び第三者への提供の停止を行うことのできる権限を有するものをいいます。

Prescribed in Item of Article 2, the Act on the Protection of Personal Information (hereinafter referred to as the “Act”), Act No. 57 as of May 30, 2003.（個人情報の保護に関する法律（平成15年法律第57号　以下「個人情報保護法」といいます。）第2条第1項。）

Acquisition of Personal Information (個人情報等の取得)

We shall announce or notify purpose of use of Personal Information according to this Policy and aquire Personal Information properly. Method of aquisition of Personal Information would be; 弊所は、本ポリシーにより個人情報等を取得する利用目的を公表または通知し、適切に個人情報を取得します。取得方法は以下による方法がありえます。

  • provided by document (including electric method such as Inquiry Form, email, SNS etc. It also includes through paper documents as well as electric files in PDF, jpg and other graphics data (文書による提供（WebフォームやEメール、SNS等の電子的手段を含む。紙文書による他PDFや画像データ等の電子ファイルによる場合を含む）
  • Face-to-face or online consultation and phone consultation with the person himself/herself or related person 面談・電話等での本人または関係者からのヒアリング
  • Aquisition of certificates issued to us based on a request from the person himself/herself or related person. 依頼により弊所が依頼者及びその関係者に関する証明書等を代理して取得

Provided, however, that it shall not apply to the case when there are special provisions in the Act or other laws and regulations. ただし、個人情報保護法その他の法令で特段の定めがある場合を除きます。

Purpose of Use regarding Personal Information (個人情報の利用目的)

Personal Information which we obtain through phone, email and documents etc. will be only used for the purpose stated below. We will not use the Personal Information for other purpose unless we confirm the consent of the person excluding the case prescribed by the laws and regulations or the case we announce or notify the purpose of use properly. Provided, however, that the purpose of use may be changed in case it is reasonable to consider that it can be related to each of the purpose of use stated below. 弊所が取得した個人情報等お電話やメール、書面等にて取得した個人情報は、下記の利用目的にのみ利用し、法令の定めによる場合又は別途利用目的を通知・公表している場合を除き、ご本人のご同意を得ない限り、その他の目的に個人情報を利用することはありません。なお、利用目的は、以下の各利用目的と関連を有すると合理的に認められる範囲で変更することがあります。

Management of Personal Data (個人データの管理)

We shall employ necessary and appropriate security measures in order to manage the Personal Data to prevent from leaking, distructing and damaging. We will respond to inquiries on contents of the measures for safety management at the person’s request without delay according to the laws and restrictions. 当事務所は、個人データについて、漏えい、滅失又は毀損の防止等、その管理のために必要かつ適切な安全管理措置を講じます。安全管理措置の内容は、法令に基づき、本人の求めに応じて遅滞なく回答いたします。

We shall supervise, as necessary and in an appropriate manner, employees, outsourcing contractors (including subcontractors) who handle the Personal Data. 個人データを取り扱う従業者や委託先（再委託先等を含みます。）に対して、必要かつ適切な監督を行います。

In the event that Personal Data is leaked, lost, damaged, or other incident which requires security control of Personal Data is occured and there is a high risk of harming the rights and interests of individuals, we will notify the Personal Information Protection Commission and the person himself/herself about the situation as required according to the laws and regulations. 個人データにつき、漏えい、滅失、毀損その他の個人データの安全の確保に係る事態であって個人の権利利益を害するおそれが大きいものが生じたときは、法令の定めに従い、必要に応じて、当該事態について個人情報保護委員会及び本人に対して通知を行います。

Joint Use of Personal Data (個人データの共同利用)

We may use Personal Data jointly as follows; 当事務所は、個人データについて、以下のとおり共同利用させていただく場合があります。

Provision of Personal Data to the Third Party (第三者への提供)

We do not provide Personal Date to the third party except as may be permitted by the Act and other laws and regulations or as may be prior consent. 当事務所は、あらかじめ同意がある場合又は個人情報保護法その他の法令で認められている場合を除き、個人データを第三者に提供いたしません。

Request of notification, disclosure, amendment and suspension of use etc. of purpose of use regarding Retained Personal Data (保有個人データの利用目的の通知、開示、訂正、利用停止等の請求)

We will respond to the request according to the Act after confirming the requrester is the person himself/herself or the proxy in case that the person himself/herself requests the following items regarding Retained Personal Data. 当事務所は、保有個人データに関して、本人から次の各号のご請求があった場合には、本人または代理人からのご請求であることを確認のうえ、法の定めに従って対応いたします。

For the request of disclosure of the items 1 and 2 below, we shall charge 1,000 yen per request for handling charges. Method of the payment shall be by postal mail order to the “Contact for Inquiry” listed in the following clause. Regarding the items 2, 5 and 6 below, method of disclosure shall be by sending through email in principle. Provided however, it shall be by sending paper documents to the address of the person himself/herself by mail in case that the person himself/herself requests the method or it is difficult to send through email or it costs enormous expenses. なお、かかる請求のうち、第1号及び第2号の開示請求については、手数料として1件あたり1,000円の手数料を徴収いたします。次項の「問い合わせ窓口」宛に郵便為替をお送りいただく方法にてお支払いください。また、第2号、第5号及び第6号の開示の方法は、原則として電子メールによる開示としますが、本人が求める場合、又は電子メールによる方法が困難な場合、若しくは多額の費用を要する場合は本人の住所宛ての書面の郵送による開示とします。
